In November, the government announced proposals to dramatically change the law about access to settlement.
The route to settlement will be increased ten years as a ‘starting point’ (‘the baseline 10-year qualifying period’). This proposal will be implemented – it is not subject to consultation.
The proposal suggests that this ‘baseline 10-year qualifying period’ will be possible to extend or reduce (‘will be based on a ‘time adjustment’ model’) as a result of various factors, including accessing public funds. The details of this are subject to consultation.
We have prepared a briefing on the government’s consultation. You can read it here.
We will respond further in due course, and share updates when we have them.
